Terms of Travel

Reservations: Please contact your Travel Agent or visit ecoamericatours.com, call our Reservations Office located in Spring, TX at (888) 601-8411.

Prices: Unless otherwise indicated, prices are per person and are subject to change and availability at time of booking. Once your booking is active, the price is firm.

Booking Activation Deposit: A deposit per person is always required to activate a booking process. Since the required deposits vary depending on the country, or specific location, or selected accommodations, please refer to the important notes section in your quote/itinerary to determine the per person deposit to activate your reservation. During certain seasons or for other specific features included in your itinerary, some of our suppliers may require an additional deposit, if so, you will be notified accordingly.

Final Payment: Depending on your destination and/or special conditions imposed by some of our suppliers, the balance is due between 90 and 65 days prior to the beginning of your trip. If full final payment has not been received by the due date, as indicated in your invoice, EcoAmerica Tours reserves the right to cancel the reservation without notice.

Method of Payment: For your convenience, we accept major credit cards, US Dollars checks, money order, wire transfer, and PayPal. All payments made within 30 days of departure must be made by credit or debit card. Please note that there is a $50.00 fee for returned checks and payments made by wire transfer must include an additional $45.00 wire transfer fee.

Documents: Provided final payment is received on the indicated due date, the PDF version of the travel documents will be sent via email at least 30 days prior to departure date. As long as we have in our records your complete street address, a hard copy of the travel documents will follow via USPS Priority Mail at no additional cost.

Cancellations and Refunds: Cancellations will only be accepted in writing. In addition to the suppliers’ fees and/or penalties, if any, the cancellation fees will be applied according to the date when your notice of cancellation is received, as shown below:

Bookings under deposit: For cancellations received in writing 66 days or more prior to travel date, the total amount of the deposit will be protected through a Future Travel Credit.

For bookings partially paid or paid in full, the amount corresponding to the original deposit will be protected through a Future Travel Credit. The subsequent either partial or final payments can be also protected through a Future Travel Credit without incurring in any cancellation penalties. In case you opt for a refund of such remainder amount:

∼ For cancellations received 66 days prior to travel date, In addition to the suppliers’ fees and/or penalties, a cancellation fee equal to 25% of the total received will be applied. 

∼ For cancellations received between 65 and 31 days prior to departure date, In addition to the suppliers’ fees and/or penalties, a cancellation fee equal to 50% of the total received will be applied. 

∼ For cancellations received less than 30 days prior to departure date, there are no refunds.

• Deposits for Galapagos Cruises are non-transferable and non-refundable. This type of deposits may be protected only when the request is to postpone the travel dates.

• Specific items such as the Inca Trail, Machu Picchu (including Machu Picchu Mountain Huayna Picchu), and other National Parks are non-transferable and non-refundable.

• Certain custom-designed programs may require the application of specific cancellation terms; whenever this requirement applies, you will be notified before the services are confirmed.

• There are no refunds for unused services.

• Air tickets cancellations and/or changes are subject to the corresponding airline policies, terms & conditions.

Travel Protection Plan:

Travel insurance is a great way to protect your travel investment. By choosing to offer travel insurance, your travel agent is providing you a financial safety net for most unforeseen travel inconveniences. Allianz Travel Insurance plans have been created to suit most any traveler’s coverage needs. For your peace of mind, we strongly suggest you to purchase travel insurance. Traveling Internationally: To travel outside your country, everybody needs a valid passport with a validity period of at least 6 months from the date of entrance to the country to be visited. Most of our Latin America destinations do not require a visa for USA and Canadian citizens; however, this privilege may change without prior notice. Please check with the corresponding Consulate or Embassy, and/or with the airline you have selected for your international flights. Citizens of other countries may require visa(s), please check with the nearest Consulate or Embassy. EcoAmerica Tours is not responsible for denied boarding. Baggage Allowance (per person): On sight-seeing vehicles: one suitcase up to 50 lbs. On light aircraft, one suitcase up to 25 lbs. Tour participants are requested to check with their own international airline for applicable baggage allowance. EcoAmerica Tours accepts no liability for loss or damage to luggage, and/or excess luggage charges; this is the traveler’s responsibility. Luggage insurance is recommended.

Terms of Travel: Prices and conditions are subject to change without prior notice. Hotel and/or Lodge Rooms and/or Ship Cabins are standard Run-of-the-House Basis unless otherwise indicated. Triples and Children use existing beds. Extra Bed Charges may apply. We accept no responsibility for losses or expenses caused by delays or changes to schedules by the airlines and/or other transportation suppliers. We further decline responsibility for losses or accidental expenses incurred because of defaults, sickness, weather conditions, strikes, war, riots, insurrections or other such similar causes. These losses and/or expenses are the responsibility of the traveler. No refunds for unused services. The operator and its representatives and/or suppliers reserve the right to decline to accept or retain any person as a tour passenger should such person’s health or mental condition or physical infirmity or general deportment, impede the operation of the tour or the rights or welfare or enjoyment of the other tour passengers, in which case a refund for unused land services is the limit of EcoAmerica Tours liability.

EcoAmerica Tours acts as service coordinator between the service provider and the end user, as such our responsibility to tour participants is limited. Tour participants agree that the maximum liquidated damages shall not exceed the price of the land and/or cruise tour purchase.

As service coordinator, we are responsible to the participants for coordinating all services offered by independent suppliers such as: hotels, lodges, cruise lines, sightseeing, and transportation by bus, boat, van, car, train, airplane, vessel, or any other type of vehicle, tour and/or sightseeing guides, hotel, lodge, cruise ship, restaurant and/or tour meals, or any other service listed as an included feature in the tour programs. The tour programs are subject to change; such changes may include revisions to pre-scheduled routings, features, locations, and hotels, lodges, cruise ships, and any other included feature and/or service.

In the event that EcoAmerica Tours is unable to substitute the feature and/or service for one of equal value and/or category, our liability shall not exceed the actual cost of such feature and/or service. Tour participant agrees that when booking any of EcoAmerica Tours they fully understand that all services and/or features in any of EcoAmerica Tours are provided by local suppliers, and that in the event that the tour participant seeks damage compensation, he, she, them, will seek such compensation directly from the supplier.

EcoAmerica Tours shall not be held responsible for any medical expense(s) incurred by Tour Participant before, during or after the tour.

Responsibility: EcoAmerica Tours, LLC of Spring, TX, is a Destination Management Company and supplier-appointed tour operator. We arrange with cruise lines, airlines, hotels, and other independent parties to provide you with the travel services you purchase. These parties are independent suppliers over whom we have no direct control. We are responsible to you for all services and accommodations offered, which are under the direct control of EcoAmerica Tours. However, in the absence of negligence on our part we are not responsible for any claims, losses, damages, costs, or expenses arising out of injury, accident or death; damage or delay of baggage or other property; or delay, inconvenience, loss of enjoyment, distress or frustration, whether physical or mental arising from (1) the act or omission of any party other than EcoAmerica Tours or its employees; (2) mechanical breakdown, government actions, weather or other factors beyond our control; (3) failure to obtain documents, passports, visas and health certificates valid through the date of reentry, when required, in which case a cancellation charge will be assessed; (4) failure to follow instructions including but not limited to check-in and check-out times and baggage handling; (5) cancellation or change for any reason in travel services offered; and (6) medical or health problems or physical disabilities. Any claims will be decided in accordance with the laws of the State of Texas.

EcoAmerica Tours reserves the right to cancel or alter the travel services at its discretion except as otherwise noted herein. In the event of complete cancellation by EcoAmerica Tours, we shall refund all monies paid to us. No agent, employee, or representative of EcoAmerica Tours or any person whose services are used by EcoAmerica Tours has the authority to alter, modify or waive any of the provisions herein.

Travelers choosing to participate in these vacation programs do so at their own risk. EcoAmerica Tours is not to be held responsible for injuries, damage expenses and/or costs resulting from accidents or accidental death while participating in these vacation programs.
